1. About these Terms

Welcome to ArtOfClone (The Art of the Clone, artoftheclone.ai — the 'Service'), provided by PainPoint Technologies Co., Ltd. ('we', 'us').

By using the Service you agree to these Terms. If you do not agree, please do not use the Service.

The Service helps you build a 'Digital Double' that represents you, creates content in your own voice, and — once you connect and authorize your own accounts — publishes to them.

2. Accounts & eligibility

• You must be at least 18 years old (or the age of majority where you live) to use the Service.
• You are responsible for the accuracy of your information, for keeping your account secure, and for all activity under your account.
• One account maps to one Digital Double, subject to your plan.

3. Your Materials & Content — you own them

You keep all rights to the materials you provide (photos, video, voice, text — 'Materials') and to the content produced from them ('Content').

You grant us a licence to use your Materials and Content solely to provide and operate the Service (for example, to build and run your Digital Double and to create and publish Content). This licence ends when you delete the Materials or terminate the Service, except where the law requires us to retain data.

We do not claim ownership of your Materials or Content.

4. Your representations

• You represent that you are the person shown in the Materials, or that you have obtained the clear consent of everyone shown in them, and that you have the right to provide the Materials and to grant us the licence above.
• You represent that your Materials and Content do not infringe anyone's rights and are not unlawful.

5. Only your own Double — no impersonation

• You may only build a Digital Double that represents you, or a person you are legally entitled to represent.
• Creating a Double that impersonates or misrepresents the identity of another person is strictly prohibited.
• You may not use the Service for anything unlawful, deceptive, fraudulent, hateful, harassing, sexual/adult, election misinformation, or spam.

6. AI output — your review and responsibility

The Service uses artificial intelligence to generate Content. AI output can be inaccurate, imperfect, or unexpected.

You should review Content before relying on it. You are responsible for the Content published to your Connected Accounts.

Copyright in AI-generated Content may be uncertain under the laws of your jurisdiction. We do not guarantee that AI output is registrable for copyright or carries exclusive rights.

7. Connected accounts & third-party platforms

You may choose to connect your own social accounts (such as Instagram, Facebook, Threads). You perform the connection and authorization yourself, and you can disconnect at any time.

Your use of each platform is subject to that platform's own terms and policies. Platform suspensions, policy changes, or API changes are outside our control, and we are not responsible for them.

We access data from your Connected Accounts only within the scope you authorize, and use it as described in our Privacy Policy.

8. Subscription, billing & auto-renewal

• Some features require a paid subscription. Prices and plans are shown at checkout.
• Payment is handled by our third-party payment provider, Portaly (TapPay). We do not store your full card number.
• Subscriptions may renew automatically until you cancel. You can cancel in your account settings or by emailing [email protected]; cancellation takes effect at the end of the current period.
• Refunds and any cooling-off period follow applicable law (including consumer-protection law). Because this is a digital service delivered immediately, a cooling-off right may be limited.

9. Free preview & regeneration

The free preview is a one-time sample. The number of regenerations is set by your plan.

10. Our intellectual property

The Service, the brand (ArtOfClone / The Art of the Clone / 分身藝術), the software, design, and trademarks belong to us or our licensors. Except as expressly stated in these Terms, no rights are granted to you.

11. Changes, suspension & termination

• We may update or change the Service.
• You may stop using the Service and delete your account at any time.
• If you breach these Terms, we may suspend or terminate your access.

12. Disclaimers & limitation of liability

The Service is provided 'as is', without warranties of any kind to the extent permitted by law.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid in the 12 months before the claim arose.

13. Indemnification

You agree to indemnify us for losses arising from your Materials or Content, your breach of these Terms, or your unlawful use of the Service.

14. Governing law & jurisdiction

These Terms are governed by the laws of the Republic of China (Taiwan).

The parties agree that the Taiwan Taipei District Court shall be the court of first instance for disputes arising from these Terms.

15. Changes to these Terms & contact

We may revise these Terms and will post changes on this page; we will give notice of material changes.
